Site access

We do everything within our power to ensure that the Site is available 24 hours each day. We are not liable if the Site becomes unavailable for any length of time for any reason. Site access may be temporarily suspended without notice in situations involving maintenance, system failure, repair or due to unexpected occurrences outside of our control.

Placing a Paepy Order

Every order is subject to Site acceptance. We will provide an Order Confirmation. We reserve the right to refuse any order. The Order Confirmation will supply order details including the price and may also provide a delivery time estimate. As long as payment is received in full, we will begin processing your order once the Order Confirmation has been emailed. Orders cannot be cancelled after they are accepted. If for any reason we are unable to fulfill an order after accepting full payment, we may cancel the contract related to the Product ordered and refund the amount paid. The amount will be refunded in either the way it was charged or as part of store credit. Paepy will have sole discretion to choose from either of these refund modes.

All users are advised that delivery times and dates provided by us are estimates. We will make a reasonable effort to ensure that the estimated delivery time is met. We are not liable for deliveries that are made outside of the estimated time frame.

You understand and accept that all details you submit to us for the purpose of placing an order through the Site is accurate and correct.

Payment, Currency & Price

All prices indicated are inclusive of taxes.

We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

Payment for orders must be submitted as instructed on the Site at the time the order is accepted. You will be required to provide accurate payment information and accept all terms and conditions related to a third party payment service. We exclude to the fullest extent permissible by law any liability related to use of a third party payment service.

You understand that all information gathered from you for the purpose of placing and delivering an order is correct and accurate. You also verify that your payment method is your legal property and that sufficient funds or credit is available to cover the entire cost of your order.

COD- If you do not have access to online payment methods, you can pay using Cash on Delivery (COD) method. At the time of delivery you would be expected to have cash to pay for your order. In order for smooth buying experience and to avoid delays you should only opt for this option when you have someone or your own self present at the delivery address to receive the COD orders.

Order Delivery

Your Order will be delivered within 3 to 14 business days after shipment. Please note that this is not a guaranteed delivery date for your order. Some areas may take longer due to the frequency of deliveries to the delivery zip code. Our logistics partners will make every effort to deliver within the time provided.

The delivery location for your Product(s) will appear on the order. The standard method of delivery will be regular postage.

We will do everything we reasonable can to process orders and manufacture Product within the delivery time estimate provided by us. Manufacturing times may vary and the delivery information provided is only an estimate. We are not liable for any expenses or loss incurred due to a delay in delivery of Product.

We reserve the right to ship orders in installments as necessary.

If you choose to wrongfully deny or fail to accept delivery of an order, we are under no obligation to provide a refund for the order. If delivery is refused or an inaccurate address was provided by you, you will be charged all applicable re-delivery fees.

Delivery complaints or claims for Product must be submitted to us within 14 days of receipt of Product(s). In cases of non-delivery, claims must be submitted in a reasonable time period from the expected delivery date.

Refund Mode and duration

If the payment was made by Credit Card or Net-Banking, we can reverse credit to the Credit Card or credit your Net-Banking account, if and only if order hasn't been processed. Refunds are only subjected when cancellation is duly informed immediately. It takes 15 business days for refund, depending finally on the bank (additional delay for nationalized banks).

Refunds, Returns & Cancellation Rights

You retain the right to cancel an order if any of the following apply:

(a.) We fail to deliver your order within 14 days of the date you submitted the order

Or

(b.) If a Product is defective and we have been alerted promptly. Notification must be provided at the earliest opportunity after discovering a fault or defect in the Product. You must inspect the Product as soon as is reasonable after delivery, and should never be longer than 3 days after receiving the Product.

We are responsible for all amounts paid for the order (including any initial fees and re-delivery charges if applicable) if either of the two conditions listed above (a or b) are present.

Except in regards to defective Product(s), nothing within the Site’s Terms and Conditions gives you any right of cancellation for Products.  All returns must be made in the original Product packaging. You are advised that original packaging should be retained for this reason.

Product once received will be checked by team Paepy and informed decision regarding acceptance of replacement will be conveyed immediately.

Orders can be cancelled within 1 day of order placing (before shipment of item). You can raise a cancel request to Customer Support Team at our helpline number or email at thepaepystore@gmail.com by providing Order Number.

Third Party Websites & Links

The Site may contain links to websites managed and owned by third parties. We have no control over these sites, including Facebook, Instagram and the payment gateway. They are provided for convenience reasons only. We make no guarantee, warranty or representations regarding any third party website which may be accessible through the Site as well as any services or product they provide. You agree that the Site is not liable in any way related to arrangements, deals or transactions (including the purchase of services or products) that you complete on any third party website.

 

Liability

We warrant that Product(s) purchased from us through the Site are reasonably fit and of satisfactory quality for its intended purpose. We disclaim all other representations, conditions, warranties and statements that express or imply (whether by statute, common law, custom or other method) as permissible under law.

We strive to ensure that all information displayed on the Site is accurate, correct and free of errors. Changes can be made without notice and may include content related to Product, prices and fees.

We do not guarantee that the Site and all applicable content as well as all functionality of the Site will be free of errors and uninterrupted.

We hold no liability to you other than liability related to direct loss or damage, whether in tort (including breach of statutory duty, negligence or other tort), contract or otherwise and whether it was caused by our act or an omission as well as those of our agents, officers, directors, shareholders, subcontractors and employees. Our liability in respect to an order shall be no more than the amount paid by you to us for Product.

We, along with our directors, agents, shareholders, officers, subcontractors and employees, are not liability to you or any third party, whether in tort (including breach of statutory duty, negligence or other tort) or otherwise for any loss of revenue, business, data, profits, anticipating savings, goodwill, reputation or opportunity or business interruption; or for any special, consequential or indirect loss, damage, cost or other claims.

Nothing included in these Terms and Conditions shall limit our liability for or exclude:

·        Personal injury or death caused by our negligence

·        Loss suffered by you as a result of fraudulent representation made by us

·        Liability which cannot be limited or excluded under law

We are not liable for any costs, expenses (such as loss of profit), damage, or loss occurring directly or indirectly from a failure to delay when performing obligations under the Terms and Conditions by reason of circumstances or an event that is outside of our reasonable control. This includes but is not limited to industrial action, strikes, power supply failure, equipment failure, Act of God and government action.

Indemnity

By using the Site, you agree to indemnify us against all claims, expenses and liabilities that may occur because of or in connection with a breath of the Terms and Conditions by you or through a Paepy account.

Termination

We reserve the right to cease any service we offer or remove the Site at our discretion without prior notice for any reason.

We also reserve the right to terminate your Site access for any reason at our sole discretion without prior notice. This will be done without effecting your current orders.

Data Protection & Privacy

The personal information we collect is only used in accordance with the Site’s Privacy Policy. It is essential that you read our Privacy Policy. By accepting the Terms and Conditions, you are also agreeing to accept the Site’s Privacy Policy.

Governing Law

The Site’s Terms and Conditions and every order is governed by all applicable laws of India.
